These Terms are a general agreement for using Funcell Games' games and services. If your legal team maintains a different or additional version, that version takes precedence — tell us and we'll update it.

Welcome to Funcell Games. These Terms of Service ("Terms") govern your access to and use of the games, applications, websites, and related services (together, the "Services") published by Funcell Games UK Limited ("Funcell Games", "we", "us", or "our"). By downloading, accessing, or playing any of our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

You are responsible for keeping your login details secure and for all activity that happens under your account. 4. Virtual Items and Purchases

Our Services may offer virtual goods, in-game currency, or other digital items ("Virtual Items") for purchase or as rewards. Virtual Items have no monetary value, cannot be exchanged for real money, and are licensed to you — not sold. You do not own them. We may manage, regulate, modify, or remove Virtual Items at any time.

All purchases are processed by the relevant platform or app store (for example Google Play, the Apple App Store, or a host platform). Payments, billing, and refunds are handled under that platform's terms and policies, and any refund request should be directed to them.

5. Advertising

Some Services are supported by advertising, which may include third-party advertisements and rewarded ads. Advertisers and ad networks operate under their own terms and privacy policies, and we are not responsible for the content of third-party advertisements or the products and services they promote.

6. Acceptable Use

When using the Services, you agree not to:

• Use cheats, bots, automation, exploits, or unauthorised third-party software to gain an advantage or interfere with the Services;
• Harass, threaten, or harm other players, or post unlawful, offensive, or infringing content;
• Attempt to access, disrupt, or damage our systems, servers, or networks;
• Use the Services for any illegal purpose or in breach of any applicable law; or

Except for the limited licence granted above, these Terms do not give you any right, title, or interest in the Services or our intellectual property. "Funcell Games" and our game titles and logos are our trademarks and may not be used without our written permission.

8. Third-Party Platforms and Services

Our Services may be offered on or interact with third-party platforms and services, such as app stores, social networks, and host platforms including TikTok. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for third-party platforms, and your dealings with them are solely between you and that third party.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Funcell Games and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Services. Nothing in these Terms excludes any liability that cannot be excluded under applicable law.

11. Indemnity

You agree to indemnify and hold harmless Funcell Games from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Services or your breach of these Terms.

12. Termination

We may suspend or end your access to the Services at any time if you breach these Terms or if we discontinue a Service. You may stop using the Services at any time. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.

When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice through funcellgames.com or within the Services. Your continued use of the Services after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of England and Wales. Subject to any rights you have under applicable law, the courts of England and Wales will have jurisdiction over any dispute arising out of or relating to these Terms or the Services.
